DEC Proposes Rule Change To Eliminate Open Burning

In an effort to reduce the impacts of pollutants such as dioxins, particulate matter and carbon monoxide and to limit the risks of wildfires, the New York State Department of Environmental Conservation (DEC) is proposing to extend the ban on open burning statewide. Open burning of residential wastes in any city or village, or in any town with a population of 20,000 or more has been prohibited since 1972.

The Board of the Australian Pesticides and Veterinary Medicines Authority (APVMA) hastoday put industry on notice that it intends to stop the use of Copper Chrome Arsenate (CCA) as a timber treatment in certain domestic situations such as decking and children's playground equipment by the end of 2003 unless there is conclusive proof that continued use is safe.

A Legislative committee approved a measure yesterday to make Maine the first state in the country to restrict the sale and disposal of arsenic-treated wood. The bill would also require that home buyers be advised to test for arsenic in their well water and seal pressure-treated wood decks on an annual basis to reduce arsenic exposure.

Attached is the City of San Francisco's ordinance banning the use of arsenic treated wood in City operations and construction projects. There is one exemption to the ordinance granted to salt-water immersion applications (i.e. pier pilings).
EU bans arsenic in wood preservatives

The European Commission yesterday announced a ban on the use of arsenic in wood preservatives, except for a restricted number of industrial applications. The ban, to be in place by 30 June 2004, will also apply to treated wood. Senator Gloria Romero (D-Los Angeles) introduced legislation (SB 1393) to ban the use of arsenic wood in California. Yesterday, the US Environmental Protection Agency announced that it had accepted an industry voluntary agreement to phase out residential use of the product by 2004.
