Cory,
Given that CCA wood is being phased out, you may be able to use the arguement that replacing damaged boards in the future will result in unsightly differneces in the look of the fence as the CCA wood will no longer be available. This will of course highlight the fact that CCA wood was used but was removed from the market.
Another possibility is to offer to cover a larger portion of the additional cost of the using cedar.
Alternatively, you can put a cedar fence on your side of the property line. They will have no say in the matterials used, but of course, you'll have to cover the full cost.
Fences are a challenge.
